Terms of Service for Service Providers

Welcome to Campze Pro, a platform designed to connect talented caterers and other service providers like you with clients seeking exceptional services. These Terms of Service ("Terms") govern your access to and use of the Campze Pro platform as a service provider ("Service Provider," "you," or "your"). By registering for or using Campze Pro, you agree to comply with and be bound by these Terms. For information on how we collect, use, and protect your data, please refer to our Privacy Policy.

1. Definitions

"Client"
Any customer booking services through Campze Platform, Campze AI, Timzy, or affiliated third-party services managed by Campze.
"Campze Platform"
The digital marketplace connecting Providers with Clients, operated by Campze Pro.
"Provider"
You, as a service provider offering:
  • Accommodation (hotels, lodges, campsites)
  • Attractions (museums, parks, cultural sites)
  • Experiences (tours, activities, workshops)
  • Camp Counsellors (student supervisors)
  • Transport services (vehicles, drivers)
  • Catering services (food and beverage provision)

2. Provider Eligibility & Registration

2.1 Requirements

All Providers must:

  • Be a legally recognized entity or individual capable of providing services in South Africa. For sole proprietors, specific business registration may not be required, but all other applicable licenses and permits must be held.
  • Hold all necessary licenses, permits, and certifications required by local, provincial, and national authorities relevant to their specific service offering (e.g., PDP for drivers, health permits for caterers). Tourism grading is not a mandatory requirement for listing on Campze Platform.
  • For roles involving minors (e.g., Camp Counsellors), submit valid police clearance certificates.
  • Provide accurate, complete, and up-to-date information during the registration process and throughout your use of the platform.

2.2 Account Management

  • You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.
  • Use unique login credentials; sharing credentials is strictly prohibited.
  • Immediately report suspicious activity or any unauthorized use of your account to Campze Platform.

3. Provider Obligations

3.1 Legal Compliance and Service Quality

As a Campze Pro Service Provider, you agree to:

Accommodation Comply with Consumer Protection Act (CPA) regarding booking and cancellation.
Transport Comply with National Land Transport Act; ensure vehicle fitness per Road Traffic Infringement Agency (RTIA); drivers must hold valid Public Driving Permits (PDPs).
Experiences Obtain relevant Department of Environment, Forestry and Fisheries (DEFF) permits for nature-based activities; adhere to adventure tourism safety regulations; provide certified guides.
Camp Counsellors Comply with Children's Act 38 of 2005; fulfill mandatory reporting duties for child welfare concerns; adhere to child protection policies.
Catering Services Strictly adhere to all applicable food safety laws, hygiene standards, and health regulations governing food preparation, handling, storage, and service (e.g., National Health Act, Foodstuffs, Cosmetics and Disinfectants Act).

3.2 Service Standards & Prohibited Conduct

All Providers must:

  • Deliver services as advertised on your Campze Pro profile; no false claims or misleading information.
  • Maintain high quality of service, fulfilling all accepted orders promptly and within agreed-upon timelines.
  • Maintain professional and timely communication with clients regarding their orders, requests, and any changes.
  • Notify Campze Platform immediately of any potential delays or issues that may impact service delivery.
  • Not engage in any form of **price manipulation**, including attempting to charge clients more than the agreed-upon price on the platform.
  • Not post or solicit **fake reviews** or engage in any activity designed to artificially inflate your ratings or disparage other Service Providers.
  • Not attempt to conduct transactions or solicit clients **off-platform** to avoid Campze Platform's fees.
  • Not upload any content that is illegal, offensive, defamatory, or infringes on the intellectual property rights of others.

Special Requirements:

  • Transport Providers: Display valid operating licenses in all vehicles used for services.
  • Experience Providers: Always provide necessary safety gear and ensure activities are led by certified and experienced guides.
  • Accommodation Providers: Conduct regular fire safety inspections and maintain all necessary emergency protocols.
  • Catering Providers: Ensure all food is prepared and served in hygienic conditions, maintaining proper food temperature controls from preparation to delivery.

4. Financial Terms

4.1 Fees & Payments

  • Campze Platform retains a commission on successful bookings made through the platform. The current commission rate is typically between 10-15% per booking, as detailed in your Service Provider agreement and accessible within your Campze Pro dashboard. Campze Platform reserves the right to modify its fee structure with prior notice to you.
  • Payouts for completed services, minus Campze Platform's commission, are processed daily via Electronic Funds Transfer (EFT) to your designated bank account upon the commencement of the booking. Bank processing fees may apply.
  • Tax Compliance: You are solely responsible for all applicable taxes (including income tax, VAT, and any other local or national taxes) arising from your earnings through the Campze Platform. Providers must issue tax invoices to clients, including VAT if registered. Listings on the platform must include VAT where applicable. Campze Platform will not withhold any taxes unless legally required to do so.

4.2 Cancellations & Dispute Resolution

Cancellation By Policy & Impact
Client Refunds are processed in accordance with the Consumer Protection Act (CPA) cooling-off period rules and Campze Platform's stated cancellation policy, which you agree to adhere to.
Provider A minimum of 72-hour notice is generally required for cancellations initiated by the Provider. Repeated or last-minute cancellations may incur penalties, affect your Service Provider rating, and could lead to account suspension.

In the event of a dispute between you and a client, Campze Platform may, at its sole discretion, offer mediation or intervention to facilitate a resolution. Campze Platform's decision in such matters will be binding. However, Campze Platform is not obligated to resolve disputes between Service Providers and clients and does not act as an agent for either party in such disputes.

5. Liability Provisions

5.1 Campze Platform's Limited Liability Coverage

Campze Platform acts solely as a platform provider connecting Service Providers with clients. Campze Platform does not directly provide catering, accommodation, transport, or other services listed on the platform, nor does it employ Service Providers. Campze Platform offers secondary liability coverage for Providers for certain incidents occurring during bookings facilitated through the platform, subject to strict conditions:

  1. Strict adherence to all safety protocols, industry best practices, and legal requirements applicable to your service.
  2. Documented compliance with all relevant industry regulations and licenses as stipulated in these Terms.
  3. The incident must be reported to Campze Platform immediately, and all required documentation must be provided.

5.2 Exclusions from Coverage

Campze Platform's secondary liability coverage does not extend to, and Campze Platform shall not be liable for:

  • Negligent acts, gross negligence, or intentional misconduct by the Provider (e.g., ignoring safety protocols, misrepresenting services).
  • Unauthorized service modifications or deviation from the agreed-upon service terms with the client.
  • Any foodborne illnesses, injuries, damages, or breaches of contract arising directly from the Provider's operations, for which the Provider bears primary responsibility.
  • Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the platform; (ii) any conduct or content of any third party on the platform; (iii) any content obtained from the platform; and (iv) unauthorized access, use, or alteration of your transmissions or content.
  • Actions or inactions of third-party delivery partners, payment processors, or any other third-party services utilized by you or clients in connection with services arranged through the platform.

You agree to indemnify and hold harmless Campze Platform, its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the platform or your violation of these Terms.

6. Data Protection (POPIA)

As a Service Provider processing personal information of Clients, you are subject to the Protection of Personal Information Act, 2013 (POPIA). You must:

  • Implement adequate technical and organisational measures to secure Client data (e.g., transport manifests, booking details, dietary requirements) against loss, damage, or unauthorised access.
  • Only process Client data for the purpose of fulfilling the services booked through Campze Platform.
  • Report any suspected or actual data breaches involving Client data to Campze Platform within 72 hours of discovery.
  • Cooperate fully with Campze Platform in responding to data subject access requests or any inquiries from the Information Regulator.
  • Complete annual POPIA compliance training as may be required by Campze Platform.
  • Ensure that all processing of personal information is done lawfully, fairly, and in a transparent manner, consistent with POPIA principles.

7. Termination

Campze Platform reserves the right to suspend or terminate your account and access to the platform at its sole discretion, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or any other Campze Platform policies.
  • Fraudulent or illegal activity.
  • Consistent poor performance, repeated cancellations, or significant negative client feedback.
  • Any conduct that harms the reputation, operations, or other Service Providers or clients of Campze Platform.
  • Breach of any applicable laws or regulations.

Upon termination, your right to use the platform will immediately cease. Any outstanding payments due to you will be processed, subject to any penalties or deductions for violations.

8. Updates to Terms

Campze Platform may modify these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of any significant changes by email, in-app notification, or by posting the updated Terms on the Campze Platform website. It is your responsibility to review these Terms periodically for changes.

Your continued use of the platform after such modifications will constitute your acknowledgment and agreement to the updated Terms. If you do not agree to the updated Terms, you must discontinue your use of the Campze Platform.

9. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.
  • Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located within the Gauteng Division of the High Court, South Africa.
